 PETA has just released an extremely graphic undercover video that documents horrific cruelty against pigs at a factory farm in Iowa. In the video, the workers beat the pigs with metal rods, slam the "runt" piglets head-first onto a concrete floor, and castrate the piglets without anesthesia. The screams of those pigs will haunt me forever. The video also shows the extreme confinement of breeding sows in row after row of gestation crates. I strongly recommend watching the video if you have any doubt that animals raised for food are treated cruelly before being slaughtered.

In a CNN article, PETA stated that they will turn the video over to law enforcment, and the individuals involved will hopefully be prosecuted. The factory farm in the video is a Hormel supplier, and a Hormel spokesperson called the abuses in the video "completely unacceptable." But gestation crates are OK?

Although this video is unusually explicit in its depiction of animal cruelty, there is no such thing as humane meat. No matter how well the animals are treated while alive, slaughter is inherently inhumane. The solution? Go vegan.

I guess they never expected something like that to happen here (despite the fact that the Agriprocessors “kosher” plant in Iowa has been slammed for it’s unethical slaughter practices and worker abuse).
But the kicker is, beatings and torment to these animals happens *all the time*! They are not isolated cases. I’ve heard so many comments from people in grocery stores and at college who state “what happened to those animals is terrible, but they are still meant to be eaten…”
They don’t realize gestation crates without soft bedding on concrete are these animals’ permanent homes until they die from trauma, disease, or slaughter. They can’t even turn around! Piglets are castrated, ear-notched, tail docked, and have their teeth removed without any painkillers. They live their lives in darkness to never feel the sun on their backs; to never rest in the mud. The tragedy is that these are the industry’s standards. All this is to happen to the pigs, just for our insatiable craving for flesh that we don’t even need to survive.
It’s time we evolve as a species. Our humanity is slipping away with each creature we brutalize, and life we take away. There is no mercy given to these animals, you can see it in their eyes how terrified they are. As blood and shit continues to seep into our rivers and soil, we are killing this planet and plunging it closer and closer into turmoil, all the while ripping at flesh and increasing our chances of irrepairable damage to our bodies and our home.
For the sake of all, when are people going to wake up and realize that the food industry they are giving their money to is lying to them, torturing animals, and polluting our earth, all for the almighty dollar. Make the choice that saves lives…go vegan

In July 2009, the Federal Depiction of Animal Cruelty Law was overturned by the 3rd US Circuit Court of Appeals which ruled that animal cruelty films were protected as free speech. The ruling resulted in an increase in so-called "animal crush" videos on the internet, in which small animals are intentionally tortured and crushed. Before the singing of the Animal Crush Video Prohibition Act of 2010, the only law that was in contradiction of freedom of speech is that which governs child pornography. Early this year, Chief Justice John Roberts concluded in a case involving videos of animal cruelty that Congress had failed to show that depictions of dog fights justified a special category of exclusion from the right of free speech.
The Animal Crush Video Prohibition Act of 2010 criminalizes the creation, sale, and marketing of these specific kinds of videos, which lawmakers had labeled as "obscene." Penalties of up to seven years in prison would be possible under the new law. The new law has been widely celebrated by animal rescue organizations. "We are thankful that countless animals will now be spared from intentional torture for sick entertainment and profit," said Wayne Pacelle of the Humane Society of the United States.

And Dr. Randall Lockwood, senior vice president of ASPCA Forensic Sciences and Anti-Cruelty Projects, said: "The ASPCA has long recognized the dangerous potential for animal cruelty to lead to more serious crimes. By banning crush videos, our federal government is potentially helping to protect the community from other serious crimes and sending a clear message to individuals seeking to profit from the suffering of helpless animals. This law protects both animals and free speech by focusing specifically on crush videos, which clearly have no place in our society."

However, it may not be the last time that the topic has to be addressed by the legislature, and some lawmakers think the law may face future legal challenges. Because the videos do not depict sexual activity, it can be questioned whether they can be deemed as "obscene" by traditional legal and social standards, and therefore whether they merit exclusion from constitutional freedom of speech rights.
